    The council and inspector accepted that the additional-storey proposal met the Class AA limitations considered in the appeal. It nevertheless failed the prior-approval assessment of external appearance: the extra height and blank upper front elevation would harm the house and terrace.

    What to check: Meeting the initial PD limitations is only part of a prior-approval route. Design the proposal around the matters that still require approval rather than treating eligibility as consent.

  • 52 Green Lane: a flat could not borrow a house’s PD comparison

    The proposed extension and conversion of the ground-floor flat into two flats would create an overbearing boundary alongside the neighbour. Daylight evidence was acceptable, but outlook was not. The inspector expressly distinguished a nearby house’s prior approval because the appeal property was a flat.

    What to check: Establish the property’s lawful use before comparing PD examples. A daylight report does not answer every question about enclosure and outlook.
